Supreme Court Upholds Chief Minister’s Authority in Ministerial Removal

The Supreme Court, in response to a plea by a social activist seeking the removal of arrested Tamil Nadu minister V Senthil Balaji, declared today that the Chief Minister’s consent is indispensable for such action.

Dismissing the activist’s request, the court aligned its decision with the Madras High Court’s stance, asserting that the Chief Minister holds the authority to determine the fate of Mr. Balaji, a minister affiliated with the ruling DMK.

The High Court had previously reasoned that retaining Balaji as a “minister without a portfolio in the state cabinet serves no purpose.”
